Have you received a message from us? Here is why we have your contact details, and how to stop us contacting you.
One refusal stops everything
Whatever your words and whatever the channel, a request to stop ends all contact from us as soon as we read it: no more emails, no more calls, no more LinkedIn messages, and no coming back later. You can also refuse a single means of contact, calls for example, by saying so in your reply: we will then stop that one only. In our emails sent to Belgium, a personal link also lets you refuse in a single click, with no further confirmation. We confirm it with one short message, with no sales offer.
This page explains how E-GBAVOU SARL processes the data it uses for its prospecting and its partnership proposals, by email, by phone and on LinkedIn. It applies to the contact details you gave us as well as to those we found elsewhere. It complements our privacy policy, which covers the website.
Who decides how your data is used
E-GBAVOU SARL, a limited liability company (société à responsabilité limitée), Agla Hlazounto C/3194, Cotonou, Benin, registered with the Trade and Personal Property Credit Register under number RB/COT/20 B 27339. For any question: contact@e-gbavou.com, or simply reply to our message.
Why we contact you
To present our custom application development services to companies whose business lends itself to them; to offer development agencies a development partnership; to invite professionals who advise companies to recommend us. We only write to you about your professional responsibilities.
On what basis
In France as in Belgium, researching your professional contact details and our calls rely on our legitimate interest in developing our business (General Data Protection Regulation, Article 6(1)(f)), where our proposal relates to your role; in France, so do our emails and LinkedIn messages. We limit ourselves to the data we need, and you can object at any time. In Belgium, where your consent is required for us to send you commercial emails or LinkedIn messages, those messages rely on that consent, which you can withdraw at any time; without consent, we only write to a company's impersonal address. If you refuse our approaches, we keep a record of that refusal in order to respect it, as the law requires (Article 6(1)(c)).
What data
Your name, your role and your company; your professional email address and phone number; the address of your public LinkedIn profile; what your company's website says about its business; the history of our exchanges: dates, messages and replies; the personal link that lets you refuse in one click, if one was sent to you; if you refuse, the record of your refusal. We do not look for any data about your private life.
Where it comes from
Depending on the case: the official business register, your company's website, your public LinkedIn profile, your company's reception desk, or yourself during a past exchange. When you give us your contact details yourself, you are never obliged to; without them, we simply cannot reply to you. Your email address may also have been worked out from your name and the address format your company publishes. The message you received says which of these sources apply to you. We do not buy any contact lists.
How we use it
A member of our team prepares and checks each approach. We make no fully automated decision about you.
Who has access
Within our team, only the people who need it: the managing director, the person who prepares our approaches, the person in charge of sales follow-up, and the sales representative who calls your company, if there is one. Our technical providers, each for its own function: hosting of our server and our mailbox (OVHcloud); sending the acknowledgement of a one-click refusal, and the internal alert that goes with it, with your name, your address and the link to your record (Resend). We neither sell nor rent your data.
Where it is kept
Our sales tracking tool and our mailbox are hosted in France by OVH SAS. Our team, based in Benin, views and edits this data from there. This access is a transfer to a country that does not benefit from an adequacy decision of the European Commission. No safeguard provided for by the European regulation covers it yet: the Commission's standard contractual clauses do not apply to this transfer, because our company is itself subject to that regulation for its prospecting. Resend, which sends the acknowledgement of a one-click refusal, processes your name and address in the United States, under the EU-U.S. Data Privacy Framework, in which it participates. For any question: contact@e-gbavou.com.
How long
- Your contact details as a prospect: three years at most after our last exchange initiated by you, or after they were collected if you never replied. Our follow-ups do not extend this period.
- An address worked out by us that led to no exchange: deleted at the end of our approach, one month after our first message at the latest. We do not work it out again to come back to you later.
- If you object to our prospecting: we keep only the identifiers needed to stop contacting you, with the date and scope of your refusal, and for no other purpose. We review this retention regularly, but we do not delete it after three years if that would lead us to contact you again.
- If we work together: the duration of our contract, then the periods the law requires for accounting.
Your rights
You can ask to access your data, to have it corrected or erased, to restrict its use, and you can object to our prospecting at any time, without giving a reason. Where we use your data with your consent, you can withdraw it at any time; withdrawing it does not affect what was done before. The right to data portability applies to the data and uses that meet its conditions. Write to contact@e-gbavou.com or reply to our message: we answer within one month. You can also lodge a complaint with a data protection authority: the CNIL in France, the Data Protection Authority in Belgium, or the authority in your country.
